WA SURF – Terms & Conditions

 

WELCOME TO WA SURF

By browsing our website, making a booking, or purchasing a lesson, you agree to these Terms and Conditions.

These Terms and Conditions apply to all lessons, courses, coaching, clinics and other water sports activities provided by WA SURF, including kitesurfing, wingfoiling and any other activities offered by WA SURF from time to time (“Activities”).

Consumer Guarantees

These Terms sit alongside your rights under the Australian Consumer Law (ACL). Nothing in these Terms limits or excludes any guarantee, warranty, right or remedy that cannot lawfully be limited or excluded under the ACL.

We are not required to provide a refund simply because you change your mind. However, we offer some flexibility as set out under Cancellations, Rescheduling & Refunds below.

Bookings & Payment

Your booking is confirmed once payment is received in full. Prices are in Australian Dollars and include GST where applicable.

Cancellations, Rescheduling & Refunds

• Unused lesson hours may be transferred to another person or carried forward for up to 2 years (731 days) from the original purchase date.

• If you need to reschedule, please contact us as soon as possible. With at least 48 hours’ notice, we will reschedule your booking free of charge.

• Customer-requested cancellations or rescheduling with less than 48 hours’ notice are not eligible for a refund or rescheduling, and the affected lesson or Activity will be forfeited.

• No-shows will forfeit the affected lesson or Activity and are not eligible for a refund or rescheduling.

These cancellation conditions do not affect any rights or remedies you may have under the Australian Consumer Law.

Weather & Seasonal Cancellations

Our Activities are weather dependent, and we only operate when conditions are considered safe and suitable for the relevant Activity and participants. Lessons or other Activities may need to be cancelled or rescheduled at short notice due to wind, weather, water conditions or other safety considerations.

If WA SURF cancels your lesson or Activity because conditions are unsuitable or unsafe, your lesson credit will not be lost and we will reschedule your booking.

As a responsible, permitted and insured operator, WA SURF operates seasonally. Certain Activities may not be available at particular times of the year due to weather conditions, permits, insurance requirements or operational considerations.

Assumption of Risk

Water sports and the Activities offered by WA SURF involve inherent risks, including the risk of injury. These risks may vary depending on the Activity, weather and water conditions, equipment used, and the participant’s experience and ability.

By participating in an Activity, you acknowledge that it involves risks and agree to follow your instructor’s safety directions and use the required safety equipment.

To the extent permitted by law and without limiting any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law, WA SURF is not liable for injury, loss or damage arising from participation in an Activity or use of our equipment, except to the extent caused by WA SURF’s negligence.

Governing Law

These Terms are governed by the laws of Western Australia and applicable Commonwealth laws.

Changes to These Terms

We may update these Terms and Conditions from time to time. Updated Terms will apply to bookings made after the updated Terms are published. The Terms applicable to an existing booking are those accepted at the time the booking was made.
